Our goal is to protect you and your rights throughout your case, including developing a compelling defense case to present to the jury. Regardless of whether you may have already made a few mistakes, now is the time to get in touch with us and speak to our criminal defense lawyers in Fairfax.

The legal help you need – now.

1. Regardless of your guilt or innocence, if law enforcement wants to speak with you about a criminal case, politely refuse and state that you would like to first talk with a lawyer. We can be reached 24/7 and will explain to you why this is the safest approach.

2. Stay calm. If you are caught in the criminal justice system, and are facing charges, it is a stressful, emotional, and terrifying experience. You should never make important decisions regarding your case until you can calmly assess the facts with your attorney.

3. It is human nature to want to discuss your case with your friends or family– but you must avoid doing so. Depending upon the seriousness of the offense, anyone you speak with could be subpoenaed to act as a witness to give evidence that could harm your case.

4. Do NOT attempt to navigate the justice system alone. Good people make bad decisions, but in the eyes of the justice system, you are just one more defendant out of tens of thousands arrested each year. Do not entrust your life to an imperfect and overwhelmed justice system.

Traffic violation attorneys in Fairfax and Manassas

Traffic violations or infractions in Virginia can result in fines, demerit points on your driving record, license loss, and even jail sentences for certain types of driving behavior. When an individual receives a traffic ticket, he or she may decide to simply pay it to avoid having to deal with the court or the belief that there is no hope of avoiding the consequences. What many people do not realize is that traffic tickets can be beaten or reduced by an experienced Virginia traffic lawyer.

  • Pleading guilty without first exploring the potential of legally challenging the violation is not a recommended course of action, especially for commercial drivers or any person who drives for a living. A driver must not only consider the penalties of pleading guilty to the current violation but consider the impact on the ability to earn a living.
  • Fines are not the only issue. As demerit points accumulate on a person's driving record, he or she risks facing harsher future penalties, increased insurance premiums as well as a driving license suspension. Serious driving offenses such as reckless driving or driving on a suspended license can carry criminal penalties, including jail time.

Traffic violations: Fighting for YOU.

If you have been cited for any of the traffic violations shown below or any other, the attorneys of Rodriguez Law Firm can evaluate the facts of your case and determine whether a legal challenge may be in your best interests:

  • DUI/DWI
  • Speeding
  • Reckless driving
  • Driving suspension
  • Driving without insurance
  • Failure to stop
  • Commercial violations
  • Work zone violations

Facts for Those Facing Traffic Violations in Fairfax, VA

1. Once a person is convicted of a traffic violation and receives a fine, the court then notifies the Department of Motor Vehicles (DMV), who assesses points.

2. Demerit points are assigned when after a conviction on a traffic violation. The demerit points remain for two years from the date you commit the offense. This time frame is different than the number of years a conviction stays on your DMV record, which is violation-specific.

3. Depending upon the seriousness of the violation, it can carry three, four, or six demerit points.

4. If you are 18 years of age or older, the DMV will require you to complete a driver improvement clinic if you accumulate 12 demerit points within 12 months or 18 points within 24 months. If you do not complete the clinic within 90 days, the DMV will suspend your driving privileges.

5. If you have a Virginia commercial driver's license (CDL), you can be barred from driving a commercial vehicle when convicted of certain violations or repeated violations.
