What is my case worth?
Every case is different. The value of the compensatory damages will reflect the long-term impact on the life and health of the victim. Three types of damages are available in Virginia:
- Economic damages: The financial losses incurred as a result of the malpractice include lost wages, lost earning capacity, medical bills, and other hard costs.
- Non-economic damages: These damages reflect the emotional anguish and pain and suffering associated with the medical error or act of medical negligence.
- Punitive damages: Punitive damages are to punish, and may be awarded in cases of gross negligence. These damages are capped at $350,000.
